This Privacy Policy is effective as May 5, 2023

This Privacy Policy describes the information we collect, why we collect it, and how it may be used. This policy applies to any information we collect on or through any websites or apps owned or operated by PicMe LLC, as well as any information we collect in person at any of our properties or at any of our events. You must agree to the provisions of this Privacy Policy if you use any of our websites or apps. We refer to our websites and apps as our "platform".

Information we may collect

Personal Information

We allow users to store, organize and share digital images, recordings and videos on our platform. We also collect other information from and about our users. We refer to the products and services offered on our platform as our "services". We may collect information that could personally identify you or that is unique to you. We refer to this information as "personal information". Examples of personal information are your:

• first and last name,
• phone number,
• full mailing address,
• email address, and
• credit card or bank account information.

We don’t consider images, recordings and videos you provide on areas of the platform that may be viewed or shared with others or the general public (collectively, "shared media") to be personal information unless required to be so treated by law. If you do not want shared media to be viewed by other users or the general public, you should not upload it or otherwise provide it to the platform.

Non-Personal Information

We may also collect information that does not, by itself, personally identify you or that is not unique to you. We identify this information as “non-personal information” in this Privacy Policy. Examples of this information are your:

• age,
• gender,
• interests,
• other demographic information,
• shared media (except when required by law to be treated as personal
information), and
• information collected from your activities on our platform or use of the services as described below.

Other Information

When you use our services, we may collect information about which features you use, how you use them, your activity on our platform, and the devices you use to access our services. This information is non-personal information. For example, we may collect information relating to pages you visit, what you click on while visiting, your other interactions with other users and the shared media you view or access. We also collect information from and about the device you use to access our services, including:

• hardware and software information such as IP address, device ID, operating system, device characteristics and type and service provider,
• browser information, and
• identifiers associated with cookies or other technologies that may uniquely identify your device or browser.

If you give us permission, we may collect your precise geolocation (latitude and longitude) through various means, depending on the service and device you’re using, including GPS, Bluetooth or Wi-Fi connections. The collection of your geolocation may occur in the background even when you aren’t using the services if the permission you gave us expressly permits such collection. If you decline permission for us to collect your geolocation, we will not collect it. To the extent allowed by applicable law, we treat this information as non-personal information.

How we may use Personal Information

We may use personal information only for the purposes explained in this privacy policy.

To provide our services to you.

We use personal information to provide our services, including:

• provide you with the services we make available, including providing customer support and responding to your requests.
• complete your transactions.
• administer sweepstakes, contests, discounts or other offers.
• develop, display and track content and advertising tailored to your interests on our services and other sites.
• communicate with you about products or services that we think may interest you, or in connection with your use of the services.

To improve our services and platform.

We may use personal information to:

• conduct research and analysis in order to review, assess, improve or expand our services.
• prevent, detect and fight fraud or other illegal or unauthorized activities.
• address ongoing or alleged misbehavior on and off-platform.
• protect the personal safety of our users of or the public.

We may use personal information to comply with legal requirements, assist law enforcement and enforce or exercise our rights.

How we may use Non-personal Information

We may use non-personal to the same extent we use personal information as described above and for any other legitimate business purposes to the extent permitted by law.

Third party vendors, partners and affiliates

We use third parties to help us operate and improve our services. These third parties may assist us with various tasks, such as data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing and security operations. We may also partner with third parties to perform research or analytics for us. We will only share personal information with these third parties if they agree to keep this information confidential and only use it to perform services for us.

We may share personal information with our subsidiaries and affiliates as long as they agree to comply with this Privacy Policy.

When required by law

We may share personal information if reasonably necessary to:

• comply with a legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation or other legal requirements;
• assist in the prevention or detection of crime (subject in each case to applicable law); or
• to protect the safety of any person.

To enforce legal rights

We may share personal information:

• if disclosure would mitigate our liability in an actual or threatened lawsuit;
• as necessary to protect our legal rights and legal rights of our users, business partners or other interested parties;
• to enforce our agreements with you; or
• to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.

For corporate transactions

We may transfer your personal information if we are involved in a merger, sale, reorganization or other change of ownership or control.

With your consent or at your request

We may share your personal information with third parties if we have your affirmative consent to do so.

Sharing Non-Personal Information and Anonymized Information

We may share non-personal information with third parties to the extent permitted by law, including in all circumstances we may share personal information as noted above, except that we only share shared media with third parties to the extent necessary to provide our services.

We consider all personal information in hashed, non-human readable form ("anonymized") to be non-personal information. We may share anonymized personal information with third parties for research or analytical purposes, as well as to deliver, customize and report on advertising you see on our platform and third party websites and apps.

Cookies and Other Data Collection Technologies; Advertising

We use and may allow others to use cookies and similar technologies (e.g., web beacons, pixels) to recognize you and/or your device(s) and to collect information about your activity on our platform. We may use them for purposes of authenticating you, remembering your preferences and settings, analyzing site traffic and trends, delivering and measuring the effectiveness of advertising campaigns, and allowing you to use features.

Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) have a “Do Not Track” (“DNT”) feature that tells a website that a user does not want to have his or her online activity tracked. If a website that responds to a DNT signal receives a DNT signal, the browser can block that website from collecting certain information about the browser’s user. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, we do not currently respond to DNT signals.

We may use information to select and show personalized ads, offers and other sponsored content that we show you. How we protect and retain your information

We take what we believe are reasonable security measures to protect against unauthorized access to or alteration of your information. Although we take steps to secure your information, we do not promise, and you should not expect, that your information will always remain secure.

We keep your personal information and shared media only as long as we need it for legitimate business purposes to the extent permitted by applicable law. We may keep non-personal information other than shared media as long as permitted by applicable law.

Because we do not sell, share or communicate in any way your personal information or shared media to another company for monetary or other valuable consideration or for cross-context behavioral advertising, “opt out” or similar rights under applicable laws are not relevant to us.

Children Under Thirteen

Children under the age of 13 are not permitted to use our services. We do not knowingly collect personal information from or about children under the age of 13.

Residents of California

If you are a California resident, you can request a notice disclosing the categories of personal information about you that we have shared with third parties for their direct marketing purposes during the preceding calendar year. To request this notice, please submit your request by email to support@picme.com . Please allow 30 days for a response. For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer such a request.

Use outside of the United States

The platform is hosted by servers located, and operated, in the United States. All your information will be stored in the United States. If you use the service from a physical location outside of the United States, you agree that:

• your use of the platform is governed by laws of the United States, the laws of the State of Utah and our Terms of Use (which includes this Privacy Policy),
• you are transferring personal information to the United States, and
• all claims are governed to the laws, dispute resolution procedures and jurisdiction set forth in our Terms of Use.

Changes to this Statement

We may change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, or by placing a prominent notice on our site.
